To use this Platform you must:

• Be at least 18 years of age. By using the Platform you warrant that you are 18 or older.
• Have the legal capacity to enter a binding contract under the Indian Contract Act, 1872.
• Provide accurate, truthful, and current registration information.
• Maintain the confidentiality of your account credentials. You are solely responsible for all activity occurring under your account.
• Notify us immediately at the contact details in Section 14 if you suspect unauthorised use of your account.

Milan Medicals reserves the right to refuse registration, suspend, or terminate any account at its sole discretion, including where false information has been provided or where eligibility requirements are not met.

3.1 Product Listings. Product descriptions, images, and specifications are provided for informational purposes. We make reasonable efforts to ensure accuracy but do not warrant that listings are error-free. We reserve the right to correct errors, update listings, or discontinue products at any time without prior notice.

3.2 Order Acceptance. Placing an order constitutes an offer to purchase. A binding contract is formed only when Milan Medicals sends an order confirmation. We reserve the right to reject or cancel any order at our discretion — including where a product is out of stock, where pricing errors exist, or where we suspect fraudulent activity — and will issue a full refund in such cases.

3.3 Quantity Limits. All orders are for personal use only. We reserve the right to impose per-order and per-customer quantity limits consistent with personal-import quantities under Indian export regulations. Bulk or commercial orders must be arranged separately and subject to additional compliance checks.

3.4 Customer Import Responsibility. You are solely responsible for verifying that the importation of any ordered product is lawful in your country of residence. We export lawfully from India; we bear no liability for customs seizure, regulatory action, or legal consequences in your destination country.

4.1 Prices. All prices are displayed in US Dollars (USD) unless otherwise stated and are exclusive of any import duties, taxes, or customs charges applicable in your country, which are your sole responsibility.

4.2 Payment Methods. We accept payment via PayPal, bank transfer, and cryptocurrency (BTC / ETH). Payment must be received and cleared before an order is processed and dispatched.

4.3 Pricing Errors. If a product is listed at an incorrect price due to a typographical or technical error, we reserve the right to cancel the order and refund the amount paid, even after an order confirmation has been sent.

4.4 Currency Fluctuation. Where payment is made via bank transfer or cryptocurrency, exchange rate differences between the time of order and the time of payment are your responsibility. Underpayments must be topped up before dispatch.

Schedule H and Schedule H1 medicines are dispensed only on receipt of a valid prescription from a licensed medical practitioner. By submitting a prescription you warrant that:

• The prescription is genuine, unaltered, and was issued to you personally.
• The prescribing practitioner is licensed in their jurisdiction.
• You are purchasing the medicine for your own personal therapeutic use.

All content on this Platform — including but not limited to text, graphics, logos, product images (where owned by us), software, and database compilations — is the intellectual property of Milan Medicals or its licensors and is protected under the Copyright Act, 1957 and applicable Indian and international law.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for the purpose of purchasing products for personal use. You must not:

• Copy, reproduce, republish, or distribute any Platform content without prior written consent.
• Scrape, crawl, or data-mine the Platform by automated means.
• Use our trademarks, logos, or brand elements in any way that implies endorsement or affiliation.

Third-party brand names and trademarks referenced on this Platform are used solely under the fair-use / referential-use provisions of Sections 30 and 30(1) of the Trade Marks Act, 1999 and remain the property of their respective owners.

You must not use this Platform to:

• Purchase products for commercial resale, distribution, or supply to third parties.
• Submit false, forged, or stolen prescriptions.
• Engage in fraudulent payment activity, including chargeback fraud or identity theft.
• Attempt to access areas of the Platform you are not authorised to access, or to interfere with Platform security.
• Post false, defamatory, or misleading reviews or content.
• Use the Platform in violation of any applicable law, including the Narcotic Drugs & Psychotropic Substances Act, 1985, or import regulations in your country of residence.
• Purchase Schedule X, NDPS-regulated, or otherwise prohibited products (see our Legal & Grievance Policy for full list).
• Harvest personal data of other users or engage in any form of unsolicited communication.

Breach of these prohibitions may result in immediate account termination, reporting to law enforcement, and civil or criminal proceedings. Milan Medicals reserves all legal remedies.

8.1 Medical Disclaimer. Nothing on this Platform constitutes medical advice, diagnosis, or treatment. All product information is for identification purposes only. Always consult a qualified healthcare professional before starting, changing, or discontinuing any medication.

8.2 Platform Availability. Milan Medicals does not warrant that the Platform will be available at all times, free from errors, or that content is always current. We may modify, suspend, or discontinue any part of the Platform at any time without notice.

8.3 Customs & Import. We export goods lawfully from India. We make no representation or warranty that goods ordered will be permitted entry into your country, and we bear no liability for customs seizure, confiscation, or any regulatory action taken in the destination country.

8.4 Third-Party Links. The Platform may contain links to third-party websites. We have no control over, and accept no responsibility for, the content, privacy practices, or availability of those sites.

To the maximum extent permitted by applicable law, Milan Medicals and its directors, officers, employees, and agents shall not be liable for:

• Any indirect, incidental, special, punitive, or consequential loss or damage of any kind.
• Loss of revenue, profit, business, data, goodwill, or anticipated savings.
• Any personal injury, death, or health complication arising from misuse of a product, failure to consult a healthcare professional, or non-compliance with product instructions.
• Customs seizure, importation penalties, legal consequences, or any regulatory action taken in the customer's country of residence.
• Delays, losses, or damage attributable to courier, postal service, or force majeure events beyond our reasonable control.
• Unauthorised access to or use of your account or personal data where you have failed to maintain the security of your credentials.

You agree to indemnify, defend, and hold harmless Milan Medicals and its directors, officers, employees, agents, and licensors from and against any claims, actions, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your use or misuse of the Platform or any Product; (c) the importation of Products into your country of residence; (d) any false, fraudulent, or inaccurate information provided by you, including false prescriptions; or (e) your violation of any third-party rights or applicable law.

Milan Medicals reserves the right to suspend or permanently terminate your access to the Platform, with or without notice and without liability, where:

• You breach any provision of these Terms.
• We suspect fraudulent, abusive, or illegal activity associated with your account.
• We receive a verified report that you have submitted a false prescription.
• A regulatory or law enforcement authority requests suspension or closure of your account.
• You initiate an unjustified chargeback or payment dispute.

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination — including Sections 6 (IP), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnity), and 12 (Governing Law) — shall survive.

12.1 Informal Resolution. Before commencing any formal proceedings, you agree to contact us at the details in Section 14 and allow us 30 days to attempt to resolve the dispute informally. We are committed to resolving disputes fairly and promptly.

12.2 Consumer Forum. Nothing in these Terms limits your right to bring a claim before the appropriate consumer forum under the Consumer Protection Act, 2019 or any other mandatory consumer protection law applicable in your jurisdiction.

12.3 Governing Law. These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.

12.4 Jurisdiction. Subject to your mandatory consumer rights, any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of India competent for the registered address of the company. You consent to personal jurisdiction in such courts.
